Former Kilifi Land Registrar Ordered to Forfeit KSh426.8 Million in Unexplained Assets

The Ethics and Anti-Corruption Commission (EACC) has secured orders for the forfeiture of assets worth KSh426.85 million linked to former Kilifi Principal Land Registrar Felix Mecha Nyakundi, his wife Stellah Nyaboke Otwori, and companies associated with the family.

The forfeiture follows a judgment delivered on September 18, 2026, by Justice B.M. Musyoki of the Anti-Corruption and Economic Crimes Court.
According to the EACC, the court found that Nyakundi and his associates had failed to satisfactorily explain the disparity between the assets they acquired and their known legitimate sources of income.

The forfeited assets include KSh233.58 million held in bank accounts and M-Pesa, prime properties valued at KSh177.11 million, motor vehicles worth approximately KSh11.9 million, and KSh4.26 million in cash recovered during a search operation.

Among the properties is Bantu Hotel along Kangundo Road in Nairobi, valued at KSh107.7 million, a residential apartment block in Utawala worth KSh35 million, a Mombasa penthouse valued at KSh19 million, and 11 parcels of land in Kilifi and Thika valued at KSh15.41 million.

The motor vehicles listed in the forfeiture order include a Land Cruiser Prado, Mercedes-Benz and Toyota Hilux.

The EACC said its investigations established that between January 2013 and March 2024, Nyakundi and his associates acquired assets cumulatively valued at KSh771.89 million.

The Commission said the assets included KSh467.76 million transacted through various bank accounts and M-Pesa numbers, landed properties worth KSh287.51 million, motor vehicles valued at KSh20.06 million and KSh4.26 million in cash recovered from the defendants’ residences.

During the period under investigation, Nyakundi’s gross monthly salary reportedly ranged from KSh69,660 in 2013 to KSh115,630 in 2024.

The EACC said Nyakundi and his associates could only satisfactorily explain the acquisition of assets worth KSh58.17 million, prompting the Commission to institute proceedings under Section 55 of the Anti-Corruption and Economic Crimes Act (ACECA) to recover assets it considered disproportionate to his known legitimate income.

The Commission welcomed the court’s decision, saying the recovery of the assets would help safeguard public resources and prevent individuals accused of corruption and unethical conduct from benefiting from proceeds obtained through such conduct.
