EACC Recovers Sh207 Million in Assets from Former Trans Nzoia County Accountant

The Ethics and Anti-Corruption Commission (EACC) has secured a court order allowing the government to recover assets worth Sh207.7 million from a former Trans Nzoia County accountant who failed to explain the source of his wealth.

In a statement dated Wednesday, October 21, 2026, the commission said the Anti-Corruption and Economic Crimes Court ordered the forfeiture of assets valued at Sh207,741,928 belonging to Andrew Biketi Musuya, a former accountant at the Ministry of Public Health and Sanitation and the Trans Nzoia County Government.

The ruling, delivered on October 8, 2026, by Justice Rose Ougo, found that Musuya had failed to satisfactorily explain the disproportion between his accumulated assets and his known legitimate sources of income.

The recovery marks another step in the commission’s efforts to combat corruption and recover wealth suspected to have been acquired unlawfully by public officials.

Properties, Bank Deposits and Vehicles ForfeitedAccording to the EACC, the forfeited assets include prime properties in Mtwapa, Mombasa County, and Bungoma, valued at Sh150.2 million.

The properties comprise two five-storey apartment blocks and a five-bedroom townhouse in Mtwapa, alongside seven undeveloped parcels of land in Mombasa and Bungoma counties.

The court also ordered the forfeiture of cumulative bank and M-Pesa deposits amounting to Sh53.5 million, as well as two motor vehicles valued at Sh4 million.

The assets were accumulated between January 2013 and October 2018, during which investigations established that Musuya had acquired wealth worth approximately Sh289.9 million.

The wealth included bank and mobile money deposits of Sh53.5 million, landed properties valued at Sh226.8 million and motor vehicles worth Sh9.6 million.

How EACC Pursued the Recovery

The commission initiated recovery proceedings under Section 55 of the Anti-Corruption and Economic Crimes Act, which provides a legal framework for recovering assets disproportionate to a person’s known legitimate sources of income where the statutory requirements are met.

The EACC had sought to recover Sh284.1 million in assets considered disproportionate to Musuya’s known income.

The court ultimately ordered the forfeiture of Sh207.7 million after finding that he had failed to adequately account for the source of the wealth.

The case highlights the use of unexplained-wealth proceedings as one of the tools available to anti-corruption authorities in efforts to recover suspected proceeds of corruption and protect public resources.

Fight Against Corruption in Kenya

The recovery comes amid continued efforts by anti-corruption agencies to pursue public officials and other individuals suspected of accumulating wealth that cannot be justified by their legitimate earnings.

Asset recovery is a key component of the fight against corruption because it seeks to deprive individuals of wealth established in court to be recoverable under the law, rather than relying solely on criminal prosecutions.

The EACC’s latest case also underscores the importance of financial accountability among public officers, particularly those entrusted with public funds and government responsibilities.

The commission has continued to use investigations and court proceedings to pursue the recovery of assets linked to suspected corruption and unexplained wealth.

The forfeiture order means the assets specified by the court are to be surrendered to the government, reinforcing the principle that wealth found to be unlawfully acquired or recoverable under the law can be reclaimed by the State.
