The Employment and Labour Relations Court has directed parties in a petition challenging the appointment of Kenya Railways Managing Director Philip Mainga to file their responses within 14 days, paving the way for a hearing later this month.
According to court documents, petitioner Masha Wario has filed a case against the Public Service Commission, the Kenya Railways Board, and other parties, questioning aspects of the appointment process involving the state corporation’s top leadership. Philip Mainga has been listed as an interested party in the matter.
The case, filed under a certificate of urgency, came before Justice Monica Mbaru in chambers on May 29, 2026. The court ordered that the application dated May 25, 2026, be served upon all respondents and interested parties, granting them a 14-day period to file their responses.
Justice Mbaru further directed all parties to appear before the court on June 15, 2026 for the hearing of the matter.
The orders were subsequently issued and signed by Deputy Registrar Rebecca Thyaka of the Employment and Labour Relations Court on June 2, 2026.
The petition adds to growing public interest in appointments to key state corporations, particularly those charged with managing critical transport infrastructure and public resources.
While the court has not made any determination on the merits of the case, the matter is expected to attract attention from stakeholders in the transport sector and governance circles as proceedings commence.
The respondents and interested parties will now have an opportunity to respond to the claims raised in the petition before the court hears arguments from all sides and determines the way forward.
The case will be mentioned before the Employment and Labour Relations Court on June 15, 2026.
